Terms of Service

1. Purpose and publisher

These Terms of Service (hereinafter "Terms") govern access to and use of the Moston service, available at app.moston.app and moston.app.

Moston is a managerial copilot for engineering managers, tech leads and engineering leaders. It is published by MossLink S.A.S, a French simplified joint-stock company, hereinafter referred to as "MossLink", "we" or "the Publisher".

By accessing the service or creating an account, you accept these Terms in full. If you do not accept these terms, you must not use the service.

2. Access and account creation

Access to the service is reserved for adult individuals acting in a professional capacity. An account is required to use Moston. Two authentication methods are available:

• Google OAuth : sign in with your professional Google account.
• Email and password : register with an email address and a secure password.

You are solely responsible for the confidentiality of your credentials. Any use of the service from your account is deemed to have been carried out by you. In the event of a compromise, notify us immediately at privacy@contact.moston.app.

3. Service description

Moston is a SaaS application that enables managers to:

• Take and centralise notes about their team members (1:1 notes, observations, feedback).
• Track actions, commitments, topics, projects and objectives (OKRs) for their team.
• Generate AI briefs before meetings, extract actions from notes and use a conversational assistant.
• Connect third-party tools via OAuth: Google Calendar, GitHub, GitLab, Jira and Linear.

AI features are powered by Anthropic Claude models. Generated content is provided for informational purposes only and does not replace the manager's professional judgement.

4. Subscription and pricing

Available plans

Moston offers two pricing plans, available on a monthly or annual billing cycle:

• Smart Manager : individual subscription for one manager. Full access to all features.
• Smart Enterprise : multi-licence subscription from 10 managers. Includes centralised account management and dedicated support.

Prices are displayed excluding VAT at moston.app. Applicable VAT is added at billing depending on your country of residence.

Trial period

Moston offers a free 14-day trial (duration subject to adjustment). During this period:

• Full access to all features is included.
• No credit card is required to start the trial.
• Upon trial expiry, access to features is suspended. Your data is retained for 60 days.

Billing

Payments are processed by Stripe; MossLink does not store any card data. Subscriptions renew automatically at the chosen period (monthly or annual). Any started period is due in full; no prorated refund is granted upon cancellation mid-period.

5. Failed payment

In the event of a failed payment at the due date, the following process applies:

• Day 0 : access to features is suspended.
• Day 7 : an automatic payment retry is made via Stripe.
• Day 30 : an impending deletion warning is sent by email.
• Day 53 : a final warning is sent.
• Day 60 : the account and all associated data are permanently deleted.

To resolve the issue, go to Settings → Subscription. Access suspended for non-payment is restored as soon as payment is received.

6. Cancellation

You may cancel your subscription at any time from the Admin Dashboard. Cancellation takes effect at the end of the current billing period. You retain access to the service until that date.

After cancellation, your data is retained in read-only mode for 60 days, during which you may export your content. After this period, your account and all your data are permanently deleted.

MossLink reserves the right to terminate or suspend your access without notice in the event of a breach of these Terms, non-payment, or abusive use of the service.

7. Account deletion

You can permanently delete your account from Settings → Danger zone.

• If you are the sole administrator of your organisation, you must first either promote another member to the administrator role, or dissolve the organisation.
• Dissolving an organisation triggers the deletion of all linked accounts and all associated data.

All personal data is erased within 60 days of account deletion, except for billing data retained in accordance with legal obligations.

8. Data ownership

Data you create in Moston (notes, actions, commitments, team profiles, objectives) remains your exclusive property. MossLink claims no ownership over this data.

• Moston does not use your data to train AI models, whether internally or through third parties.
• Your data is not sold to third parties.

By using the service, you grant MossLink a limited, non-exclusive licence to process this data solely for the purpose of providing the service.

9. Personal data

MossLink processes your personal data as data controller, in compliance with the GDPR and applicable French law.

9bis. Data Processing Agreement

By accepting these Terms of Service, you also accept the Data Processing Agreement available at moston.app/legal/dpa, which governs the processing of personal data carried out by Moston on your behalf.

10. Third-party integrations

Moston offers optional OAuth connections with third-party services: Google Calendar, GitHub, GitLab, Jira and Linear. These integrations are explicitly enabled by you and can be revoked at any time from your settings.

MossLink is not responsible for the operation, availability, or changes made by these third-party services. Data from these integrations is used solely within the scope of Moston's features.

11. Intellectual property

All elements of the Moston service (interface, trademarks, logos, code, algorithms, text) are the exclusive property of MossLink S.A.S or its licensors. Any unauthorised reproduction, extraction, or use is prohibited.

12. Limitation of liability

Moston is provided "as is". MossLink takes all reasonable steps to ensure service availability and security, without being able to guarantee uninterrupted availability.

To the extent permitted by law, MossLink shall not be liable for indirect damages, data loss, loss of business, or service interruptions. MossLink's total liability is limited to the amounts actually paid during the 12 months preceding the event giving rise to the claim.

AI-generated content is provided for informational purposes only. MossLink is not responsible for managerial decisions made on the basis of these suggestions.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing that, the courts of competent jurisdiction in the district of MossLink S.A.S's registered office shall have exclusive jurisdiction.

14. Changes to these Terms

MossLink reserves the right to modify these Terms at any time. In the event of a material change, you will be notified by email or via an in-app notification at least 15 days before the change takes effect. Continued use of the service after that date constitutes acceptance of the new Terms.
